HP finance. Car value 4.5k. outstanding credit 10k. now redundant. How do I hand back car with this differenc?
I have HP Finance on a car, current value is approx £4500. Outstanding finance is approx £10,000. How can I hand car back with this outstanding amount? Would they take the car as part payment and then have outstanding debt of the other part? Do I have any legal rights as I have been made redundant recently?
First, double check that it is hire purchase, rather than a loan. Your agreement will tell you this - if it is hire purchase it will state this near the top and there will be sections on termination rights and repossession rights.
With hire purchase agreements, you don't own the goods till you make the final payment. If you fall behind, the creditor can repossess the goods, but if you have already paid more than a third they would have to get a court order first.
You also have the right to terminate the agreement and limit your liability to 50% of the total amount repayable. This means 50% minus whatever deposit you put down, minus the payments you made and minus whatever they sell the car for. You have to terminate properly, in writing. You would only owe whatever was left over, and you could negotiate about what payments you can afford to make to clear this gradually.
If it is a loan, it is a different situation. They can't take away the car because you own it. It is all about how much you can afford to pay towards the debt.

There are a number of options and in most cases creditors have less power than most people think. While Manusardi is alternately stirring and swinging, there is little attempt to impress.
